The new Product Safety Regulation establishes a set of new obligations for manufacturers, retailer, distributors and importers – is your company prepared?
New Product Safety Regulation valid as of 13 December 2024
Companies that sell products in the EU will have to comply with the new regulations of the Product Safety Regulation from 13 December 2024. For example, every manufacturer must carry out and provide a risk analysis when offering a new product on the market; each distributor must now check for themselves and ensure that manufacturers/importers comply with their obligations under this regulation and that the product is compliant with EU safety rules.
Above all, the rules for online sales have become dramatically stricter: Retailers must name the manufacturer and a contact address of the manufacturer and/or importer in their online offers, make safety and warning notices visible in the offer and use photos that make the product visible in the size and characteristics offered (product-identifying image).
In the many new regulations of the Product Safety Regulation, there is still a lot of room for interpretation and thus uncertainty. We will be happy to support you and your company in the implementation of the new, directly applicable regulation for your business, but also in the event that you or your company will receive a warning for a failure to implement the new regulations in an appropriate and timely manner or if you or your company for the sake of economic fairness would like to demand compliance with the new regulations from competitors.
